Contracts

Drafting

Contracts can take on various forms and sizes. From short consent forms and indemnity forms to school enrolment contracts and more lengthly supplier and service agreements, Venn Attorneys assists in drafting  contracts to suit your and your customer's needs. Contracts are there to govern the legal relationship between the parties and to protect the parties in the instance of a breach or dispute. Many contracts may be verbal but it always advisible to reduce your areement terms to writing in case a dispute arises.  For example, think of instances when you might want to terminate the contract - cater for these instances in your contract.

Reviewing

Another aspect of dealing with contracts is when you are presented with a contract from the other party for you to sign and you are unsure of the implications of the terms of the contract. An advisible thing to do would be to have an attorney or legal adviser look over the contract for you to assess the risks and liabilities you may face if you enter into the contract. A little bit of money spent now on legal fees may avoid greater costs and  legal fees later. Venn Attorneys can assist you in reviewing contracts and advising you regarding the implications, risks and liability that you may face. In addition, Venn Attorneys can also make amendments to the contract so that it can be properly negotiated to suit both parties. Remember you can not be forced to enter into any contract - make sure you agree to the terms before signing!

Compliance

When drafting and reviewing contracts it is very important that you consider current legislation and laws. For example, the Consumer Protection Act ("CPA") has huge implications on the drafting of contracts and documentation for consumers. It must be in plain and understandable language and there are certain provisions that must be brought to the consumer's attention before entering into the contract. Contracts need to be drafted with these statutary requirements in mind to avoid penalties being imposed if you are found to be contravening the Act. With Venn Attorney's background in Consumer Law, the implications of the CPA are always considered in drafting and reviewing of contracts.
